Internet Speed Limited By Telephone Company

I was curious if it was legal for the telephone company (Southwestern Bell) to suddenly and without prior warning to cut telephone bandwidth in half so that modems can only get a half speed connection (i.e. from 56 k to 28.8k). They claim this is so that they can provide phone service for more people but it seems like they are providing half the service at the same cost to the customer. I suspect that they are really doing it to sell their high speed DSL lines to internet customers. What legal statutes might apply?

Telephone service and rates for it are strictly controlled by state-approved tariffs. The particular tariff concerning DSL service will provide the answer.

The tariff can be gotten from the Public Utilities Regulatory Board in OKC.
