Cancel a Contract

I signed a two year contract on 7/2008 and the selling point was a free session with a personal trainer. The appointment was set up the day I signed the contract but a few days later the trainer canceled. I spoke to the sales manager several times and he said he would find out why she didn�t rescheduled. Months have gone by and I still have never used there facility or have they rescheduled my free session. I called and requested the gym membership to be cancelled. After a week later and having to go up there he said they won�t cancel my membership. He apologized that they dropped the ball and wants to work something out with me. I am past the point of wanting to work with them. Can they legally keep me in this contract?

The answer will be in the language of the contract and the cirucumstances of the situation.

First, there is an Oklahoma Health Spa Act (Title 59, sec. 2000 thru 2012). If it applies to the company you contracted with, ask to see their registration with the Okla Dept of Consumer Credit. Next ask if their contract has the required right-to-cancel language. Next, if their services are sold on credit, they must comply with the Uniform Consumer Credit Code ("U3C").

If they don't comply with the Health Spa Act, you can argue the contract is voidable at your discretion.
