Legal Question in Credit and Debt Law in Oklahoma

Car collections legal or not?

I purchased a car from abes auto sales in 1999. They wrongfully repossessed the vehicle because I had a flat tire and had to leave it till morning. They said I could have the car back if I paid their towing expenses of 300.00 I said no because all my payments were up to date and they had no just reason to tow the vehicle from where it was. Now in 2006, I receive a call from some other company stating that if I do not pay them an amount that they will ruin my credit for the next 10 years. What do I do?

Re: Car collections legal or not?

There are a few questions I would be interested in knowing: When was the car repossessed? What did you do at that point to prove the repo was not legal? Has the collection agency only made the one phone call?

It sounds like a colection company has purchased (usually for pennies on the dollar) your old note. You (or an attorney) could write them a cease and desist letter. Stating that if they attempt to collect this debt and ruin your credit you will seek all avaiable legal remedies. Good Luck Bob
