I was arrested in 2001 on a drug charge and all the test that they ran came back negetive and they did not file my search warrent until dec. of 2002 I was wanting to know if there was anything I could do about sueing or haveing it wiped off my record.

I need more information. Are you saying they got a warrant based on your arrest from almost a year earlier? If so, the warrant is bad because it is stale. If you are saying that they waited that long to file a charge, then that is a different story. If the warrant is bad, then the evidence is suppressible and you should be able to beat the case. However, if you want the record wiped entirely clean, you must have the charge dismissed within a year from the date of the arrest. If you took a deferred sentence, your court records cxan be expunged at the conclusion of the deferred, but the arrest record will remain. Either give me a far more detailed account of what happened or call me to discuss it.
