Fathers rights

My husband (before we were married) had a child out of wedlock. The mother now three years later has pursued child support. My husband is not on the birth certificate. The mother of the child is remarried and wants her current husband to adopt the boy. They have ordered my husband to pay back child support. Is this legal? Is there any way we can get out of the back support? I don't understand how she is getting away with this.

If they can show he is the father, they have right to go after child support. When you say "they have ordered..." I assume you mean a court order. If you want to fight it, I suggest you get an attorney to dig into it to see if there's any ground on which to base an argument; however, based only on what you stated, it may be a difficult argument.
