Legal Question in Family Law in Oklahoma
My husband told me that he has been cheating on me for 6 mos. and wants a divorce. I don't want a divorce, but he wants to move in with his girlfriend. We've been married for just over 30 years. He says he's not going to move out yet because I've been a homemaker for several years and he wants to give me a chance to find employment. Basically, he said that nothing would change-financially or otherwise-until I find a job. That's when he wants to start the divorce proceedings. However, he has made arrangements to cancel his direct deposit to our bank account and said he will only deposit enough money for the bills and grocercies. This will leave him with an extra $700 per week, and me with nothing. Can he really do this before we even start divorce proceedings? If he does, this will leave me with nothing.

Until a divorce or separate maintenance action is filed, you will not be able to prevent him from taking the action he plans. Once a divorce action is filed, you can request that the court order him to move out, continue paying the bills, and otherwise provide for your support. It is probably not in your best interest to allow him to put off filing for any length of time. You really need to meet with your attorney asap.
