Wrongful Death Policy

I have a 19 yr old daughter that was killed in a car accident 2 months ago. The auto insurance company submitted a check in my name and my child's father name. It could not be deposited into my account until both names were endorsed. However he refused to sign stating he should receive half of the money. My argument is no considering he has barely been in her life, he wasn't paying for her auto insurance monthly I was, and he owes $25k in back child support. Now he's saying he is going to take me to court. Considering the basics that i have just stated, does he honestly have a case? Would any judge order me to pay him ANYTHING after he never even supported our daughter financially while she was still alive?

Let me begin by saying I am very sorry for your loss. I can only imagine the grief you must be going through.

I can not answer whether or not the court will award the father anything without knowing exactly how much he owes in back child support and how much the insurance company paid. You certainly have a claim against anything he might receive from the insurance company for what he owes in child support.
