Legal Question in Insurance Law in Oklahoma

liability paying for passanger in car wreck

My daughter was a passanger in a roll over accident that did not involve any other cars. The hospital says the driver was on drugs and alcohol. Should the drivers liability insurance pay for her hospital bill?

Re: liability paying for passanger in car wreck

The driver's insurance may be liable. If the owner of the car was not the driver, there may be another applicable policy. Further, if your daughter has uninsured motorist coverage, it may also apply. And, if your daughter lives with you, you or any other resident relative's policy may have applicable coverage. These can get complicated, and insurance companies don't often volunteer to tell you if they have an obligation to pay. I suggest you consider an attorney to help you navigate it, otherwise you can find yourself stuck with huge medical bills.
