Legal Question in Technology Law in Oregon

Domain Name Dispute

We were going to do a web site for a local firm. We were told we were going to get the work and to provide the details. I gave the customer a full layout of the site to be. As she indicated there was a hurry on the site I got the domain name with my money. In the end she decides to go with someone else. Now she wants the domain name. Do we have to give it up? The domain name is different than the name of the company she is from. There is no trademark on the name as far as I can tell. We have a demand letter from her lawyer. We are going to use the domain name ourselves. We don't want to sell nor was the offer to take it from us very inviting. Where do we stand?

Re: Domain Name Dispute

Your position is fairly strong, but it is probably in your interest to hire an attorney to write some letters and make some phone calls convincing the other side of your superior right to the name.
