''Property Release''

December 19, 2003 my boyfriend was arrested on outstanding federal warrent by port of Portland,Oregon police, and got his van towed with all of his belonging and some of mine.I want his property to be release to me but I do not what to do, US Marshell took him to Oklahoma till they figure out what to do with him. Anyways the van is to expensive to get out of inpound but I want to get whats inside the van. Please Help me.

It may be cheaper for you to just pay the impound fee and get the van out with the property, as the longer the van stays, the higher the impound fees. Short of this, you may need a Court Order to have the police ordered to release any property to you, and if so, you need a local Attorney to do that. However, you say it is "his property" you want released to you. This may require his consent, and without it, the Court may deny your request to release property.

Thank you for your inquiry. You most likely have to do a motion for return of property, which should be a stipulation between your boyfriend's attorney and the prosecuting attorney (AG or DA). With that order signed by the judge, you should be able to get all non-contraband property released to you.
