Legal Question in Criminal Law in Oregon

Little Red Riding Hood in court project, PLEASE HELP!

I am a student in 8th grade, and I am doing a project in school about treating the story of Little Red Riding Hood as a court case. My partner and I will charge the wolf in the story with attempted murder on two accounts (Little Red Riding Hood and her Grandmother). We want to know if we can charge him with 1st degree assault as well. Any help that can be provided on this and any other conflicts we may come upon will be greatly appreciated. Thank You.

Re: State v. Wolf

Even though your question says Oregon law, I would think that in most states, Mr. Wolf could be charged with aggravated assault. Burglary would probably apply because he broke into the house. How about kidnapping Grandma? Mr. Wolf clearly made a Criminal Trespass into Grandma's house. And he stalked Red Riding Hood to Grandma's house. Mr. Wolf ate Grandma and thereby confined her in a place to victimize her or to assist in the crime that he was going to commit against Red Riding Hood. Also, criminal restraint or false imprisonment in that he unlawful held Grandma (in his stomach) and exposed her to bodily harm and/or she could not escape. I would think that in spite of her escape from his body once the Woodsman came, that these would apply. NJ has a statute "Luring or Enticing a Child" which makes it a crime to lure a child to a location to commit a criminal act against the child. Once in the house and calling "Come in my dear", while impersonating Grandma, that this would meet the "enticing" requirement. I suppose you would need to prove that Mr. Wolf intended to eat her, but that shouldn't be too hard.

I also do personal injury law. So when Grandma and Red want to sue the Wolf (or I guess his Estate) for damages, let me know and we can put that law suit together as well. Good luck! Rob Gleaner

Re: Little Red Riding Hood in court project, PLEASE HELP!

Let me think on this for a moment, Didnt the wolf eat the Grandmother? That would make that 1st degree murder if he did so, then for little red riding hood you have kidnapping, assault, attempted murder and/or manslaughter, trespassing on private property, burglary, you could go with assault if you wished, however the defense may tend to have that charge dismissed because the other charges would most likely take presedence. depending on the state that the crime has been committed in you may be able to get away with additional charges.
