Can I adopt an adult with living biological parents

Several years ago, I lived with a woman and her minor child for about 7 months. I have kept in contact with the daughter during all the intervening years, and think of her as my own daughter. She is 21 now and in legal difficulty, and will begin serving a sentence soon for a federal felony. When she is released, I understand that she must serve an additional three years of parole, and that it is preferred she do so in the state in which she currently resides, Missouri, unless she moves to another state with family. She wants to move to the Pacific Northwest for a fresh start, and I am very willing for her to move in with me. Can I legally adopt her in order to provide the family connection, even though both of her biological parents are still alive?

The simple answer is yes. See chapter 26.33 RCW at http://www.leg.wa.gov/RCW/index.cfm?fuseaction=chapterdigest&chapter=26.33, and particularly RCW 26.33.140. But I don't think it would be a particularly good idea under the stated circumstances.

However, I would check with the prison and see if you qualify. Your previous legal and ongoing familial relationship with her may qualify you in the eyes of the prison administration. If they do not initially allow it, go to the person who has the power to make exceptions. I would sell it to them in terms of the increased liklihood of success of the probation because of your personal familial investment in her life.interest.
