Child Custody-live-in boyfriend

I learned 18 months ago that, after thirteen years of marriage, my wife was having an affair with a ''good friend'' of mine. She had no desire to try and repair our relationship and we were divorced a little over a year ago. I later learned that she was at least the fourth married woman to leave her husband for this man. Because of the demands of my work at the time, high school principal, I gave my wife full legal custody of our two children. Six months after our dicvorce, she moved herself and our two children, ages 9 and 11, in with this ''good friend''.

I am now paying $875 a month in child support toward their household in which this ''good friend'' is acting as the surrogate father. My daughter, the 9 year old, is unhappy with the manner in which he treats her and has expressed a desire to live with me. She tells me that he yells at she and her brother, is mean to them, and that despite her sharing her concerns about this with her mother, nothing seems to change.

I am fairly certain that, when and if, I ever broach this subject with my ex-wife, she will get angry, blame the whole thing on me and refuse to cooperate in any manner whatsoever. Do I have any legal rights that might allow me to regain custody?

Under Oregon Law, custody can be modified if there has been a change in circumstances and the change is custody would be in the best interest of the child. You should consult an attorney in order to receive an opinion on the possible outcomes in your specific case.
