Getting and Ex Girlfriend Removed From Home

A friend told his raging alcholic ex-girlfriend that she needed to make arrangements to move out. She then came back pounding on the door screaming she called the police and told them her ''beat her up''. He then left the house, but returned not to much later.

The police arrested him on the spot because she told them she wanted to press charges for domestic abuse. He bailed himself out that morning and he came over. We went to pick up his bag, brought her her prescription, but no money. We told her that he wanted her to make arrangements to go somewhere else within the next 24 hours. Her reply was she had no where else to go and he was just mad (she was drunk again). He owns house.

First, I will assume he pled not guilty to the assault Charge and will take it to trial. Second, I will assume a pretrial condition of release is that he have no contact with the alleged victim. Third, I will assume there there is no lease or rental agreement with the ex-girlfriend. If she is not present in the house remove her personal property and put it in a garage or other location when she can get access to her property. If she has a key change the locks. If she is there your friend will need to get other people to escort her (non-violently) off the property. She is not a tenant and not a spouse. Once your friend gives her notice that she is to leave his property she is a tresspasser. If she will not leave and you can not peacefully escorted her off the property call the police and have her arrested for criminal tresspass.
