Legal Question in Family Law in Oregon

my ex and I hv joint custody. I booked a trip to cancun. He now says she can't go. He hates Mexico. He won't give me the passport we both paid for. What do I do? He hasn't been following the parenting plan cause he took a new job. Wr are suppose to do 50/50 but he dropped a day. Please help??? Thanks

ANSWER:

You need to file with the court a MOTION FOR ENFORCEMENT OF PARENTING TIME ORDER, as allowed bu ORS 107.434. In your motion, you will ask the court for direct judicial approval for the trip to Cancun for an order directly father to turn over the child's passport (or be held in contempt for court for failing or refusing to do so).
