Taping of phone calls between two parties.

I have a sister that calls to make arrangements to visit our father, who lives with me. My father has a court appointed guardian. I have reason to believe my sister has been taping my phone calls. I have told her each time she calls or that I call, I do not want my calls taped. I have reason to believe that she is playing the tapes back to the court appointed guardian to create problems for me based on certain developments. I want to know about the law pertaining to this. I thought if I say No! then She cannot be taping my calls without my permission. Thank you!

The law on the taping of phone calls depends on the state(s) where each side of the conversation is located. Oregon law allows the taping of telephone calls where only one side knows/agrees to the taping. That is not true in some other states.

Oregon law only requires the permission of one party to tape a call. Here, if your sister is taping the calls, she has given the necessary "permission".

Given your concerns about this matter, you may want to assume that all of your phone calls with your sister are taped and speak accordingly.
