Legal Question in Medical Malpractice in Oregon

statute of limitation

what is the time limit one has to file a claim against a

doctor for malpractice/negligence.

The result of incorrect treatment has left life long

consequences, daily pain and ongoing physical

therapy. The condition caused by incorrect treatment is

irreversable.

Re: statute of limitation

Generally, medical malpractice in Oregon, depending on the specific facts, is TWO YEARS; however, also GENERALLY, the time runs from the date the malpractice is DISCOVERED, or, reasonably SHOULD HAVE BEEN discovered by the person injured. Generally, even THAT time is usually limited by Oregon's Statute of Ultimate Repose, which puts a ten-year limit on whatever device is used to extend the statute, such as the time of discovery.

My advice is the obvious: Talk to a lawyer, at least on the phone, to describe your situation in more detail, so you can have a more meaningful legal opinion.

Best of luck to you,
