Physical attack (unprovoked) by a supervisor in Fire Department

Two years ago I was physically attacked by a Chief in my Fire Department. Prior to that attack I had suffered a back injury on the job. This physical attack caused me both physical pain and extensive emotional pain. Although I did not file a injury claim for the physical attack, there was a witness to the event. I now find myself with daily back pain. At the time I was more concerned about protecting the Chief from discipline rather than doing what was right for me........

Although my department has a strict policy against workplace violence, they did not follow the policy one bit......I was never interviewed about the incident, there was never a investigation that involved myself......I felt betrayed and cheated as the incident was ''swept under the carpet''. This led to an extended period of emotional stress...

I was told by an Oregon attorney that I only had a 50/50 chance of being successful in a legal case against the department. If I was to lose, I was advised of the expense that would be my responsibility.....the attorney advised not to seek a case against them..

I would recommend you start calling attorneys who handle EMPLOYMENT LAW, rather than personal injury lawyers. Oddly enough, they are more likely to handle this sort of claim. The Portland Qwest Yellow Pages has a separate section under attorneys for employment law. You may or may not be barred by the statute of limitations, which is usually 2 years in Oregon, so get a hold of a lawyer IMMEDIATELY. If you can't locate an employment lawyer or get a good personal referral to one, call the Oregon State Bar's Lawyer Referral Service. Good luck.
