My old landlord charged 300.00 nonrefundable cleaning fee upon move in. But when we moved out she didn't apply any cleaning costs to that 300.00. She instead took it out of our refundable 700.00 security deposit. We did sign a paper at move in stating we were responsible for any/all cleaning including carpet shampooing, but thats redundant if we already paid a nonrefundable cleaning fee. So my question is..does she have the right to do what she did? What can we do?

You can sue her in small claims court, stating that she retained too much of your security deposit because she failed to account for the $300 you had already paid via the cleaning deposit. She would then show up in court and probably try to show that she actually spent a whole lot on cleaning and that your security deposit could be withheld for that purpose.

How do you know how much she spent on cleaning?
