Realtors Friend buys Property

When making an offer on a piece of property can the realtor fill out the offer and sign all paper work with the buyers signature? The realtor and the buyer have known each other for years.

Re: Realtors Friend buys Property

Yes. When the real estate agent who has listed the property also assists the buyer, it is called dual agency. In such a situation, the real estate agent has a fiduciary duty to both the buyer and seller. Under Oregon law, the agent cannot tell the seller that the buyer will pay more money or the buyer that the seller will take less money.

If the offer is a complicated one, or includes seller financing, I recommend that a buyer or seller contact an attorney before making or accepting the offer.
