Legal Question in Real Estate Law in Oregon

Ripped-off by the broker, no commission on $500,000.00

Suspecting her Broker and listing agent to be mischievious, My wife had the broker draw up papers specifically outlining that if my wife procured buyer on 500,000 $ timber property, she would receive 1% or 5000.

Property sold to her buyer, broker did not tell her or pay her, she found out from buyer a year later.

she has documents showing she procured buyer, but the broker intentionally left off HER name. Only her signiture remains.

Can she re-coup her earnings legally? She is a new agent.. Thx, RB

Yes. If your wife can demonstrate that she obtained the buyer, then she has the right to recover her 1% commission. She may also have a right to attorney's fees incurred in prosecuting the claim if the terms of the listing or sale agreement allow it. Please contact me if you have any more questions.
