Legal Question in Traffic Law in Oregon

damage to a car parked illegally

I backed into a car that was parked in front of fire hydrant and obviously in a no parking zone. Am I responsible for all the damage done to the other car?

Re: damage to a car parked illegally

Without any further detail about the accident, I'd say YES, you're responsible for the damage to a car that you back into, regardless of whether it's parked legally or not. The exception might be if there was something about this LOCATION which would make the illegally parked vehicle hard to see, BECAUSE of the nature of the illegal spot that it was parked in.

Without hearing ALL the detail and asking you a bunch of questions or seeing a photo, I couldn't answer your question with 100% certainty, but my take is this: You're still supposed to look where you're driving, so you're probably responsible. Your insurance company should pay it, and IF there is some reason why you're NOT responsible, you can usually count on an insurance company to find a way not to pay.

Good luck! Hope that helps.
