Legal Question in Wills and Trusts in Oregon

My 77 yr old widowed Mom is in need of help

My older brother who is 50 yrs old is now living with my mom of 77. Because he has no job and has a restraining order against him from a girlfriend. She has given him thousands of dollars only to find out he is lying. She lives alone and I am in Seattle. I am afraid this man will do her harm to get $$$ and to get her assets even though my mom has me and him listed as half and half as the heir. Because he has set up camp at her house and no laws have been broken, what can she do to get him out? If she dies while he is living there, will he inherit the house?

You need to get on line with DSHS and call and leave word with Adult Protective Services. They are like CPS but for vulnerable adults. They will help you sort out what is happening.

You can also ask the cops to do a welfare check. If you are scared for her safety, call now.

Otherwise, tomorrow get on the phone with APS. It isn't about breaking laws - if this is wrong to you, there may be a problem. Trust your gut.

Hope this helps. Elizabeth Powell
