Legal Question in Family Law in Pakistan

I want to know that if wife parents give her one gold set in her wedding, after 3 months can they ask their gold set back or wife can give it back without husband permission? if yes, can husband side also ask their gifts (in terms of gold) back what they have given to bride?

Dear, as for the gifts and presents given to the bride from the bride's parents or bridegroom's parents are concerned, it is the absolute property of the bride (According to the Dowry and Bridal Gift (Restriction) Act 1976). So when it becomes her absolute property, she can use it, make transaction or gift it to someone else. But when she go to the court for the dissolution of marriage on the bases of khulla, the gifts given by the bridegroom are to be returned.

A gift is non-returnable in Islamic law. However, its a property of wife and if she does anything with it then its up to her. Demanding a gift back is not morally right in Islam. For more do consult me at [email protected]
