Chapter 7 Bankruptcy Question

Hello. My husband and I are interested in filing bankruptcy. We want everything wiped out so we can start out fresh. Almost everything on our credit is past due by more than three years. We have some recent hospital bills and a cable bill that are newer. My husband just graduated from college. Can we file chapter 7? If we do file can we NOT include his student loans in the bankruptcy? Thank you.

Federal and state student loans are generally non dischargable in Bankruptcy. Therefore, while the credit card and other debts that you have can be discharged and gotten rid of, the student loans remain until death (When they are discharged). I offer free consultations.
