Legal Question

Divorced 1 yr. Ex still on mtge and refuses to sign quit claim per decree. House is 50K underwater and has 28 yrs @ 8.4% left. Foreclosure and tax sale loom imminent.Bank refuses to renegotiate. What happens if I file 13? What happens if she files 7? Bonus question: if she files 7, can she force a cramdown as its not her primary (or any) residence now?
