Third party contract

The employment contract between a church and it's music director states that the music director plays for all weddings at the church. Must I abide by that contract or would I be able hire someone else to play?

Re: Third party contract

It depends on how the initial contract was structured, if the contract is quiet as to this possibility you would need to seek approval from the church. But it sounds to me if you would be required to perform or be possibly in breach of your contractual obligations.

My office also offers flat rate pricing and free consultations, for additional information please visit my firm's website at www.AlleghenyAttorneys.com or by calling my office at 412.731.0865.

Re: Third party contract

The general rule for the situation you describe would oblige the music director to perform. If the church was willing to accept a substitute then hiring a replacement would be ok. Obviously, the specific contractual language may produce a different result. I offer free consultations.
