Contractor Photograpping

Is is legal for a contractor / painter to take photos inside my home without my presence or my permission?

Yes, if it's part of his way of doing business, but if you object, he ought to destroy them after the work is done.

Can he use them for his portfolio? That depends upon your consent. Is it bad business not to ask? Yes, but it might not be illegal. If you think it's really a problem, contact the BBB and ask him to return the photos and film.

Try mediating it, and that way you can express your concerns, find out what he's really up to and come to some sort of peace about it. Most people are reasonable under this situation,--your pictures probably aren't worth the bad press he's likely to get otherwise.
