Ownership

Heating oil was delivered to my house by mistake. The oil company delivered to the wrong address. Do I legally own this now or do I have to give it back ?

Re: Ownership

You asked about oil mistakenly delivered to the wrong address.

Nope you do not own the oil wrongly delivered to your address. You can either negotiate with the oil company a fair price at which to keep the oil or you can offer to give back the amount wrongly delivered.

In either case, the law does not allow a person to be unjustly enriched at the expense of another. this is particularly so when a there has been an innocent mistake.

Since the oil company doesn't want to come take the oil back and you don't want to pay for oil at a price higher than you may have otherwise negotiated then you should negotiate a discount and keep the oil.

The oil company does not have to accept your negotiation and if you choose not to accept the price they offer then you must allow them to reclaim their oil.

Regards,

Roger
