Legal Question in Credit and Debt Law in Pennsylvania

A Credit Card Account - Not Mine

I have NO credit or debt problems. I received a free credit report and was surprised to find an adverse/delinquent account against me. This credit card account is not mine. The account number begins with 02. To the best of my knowledge, I have never had a loan, credit card etc begining with 02.I have never received a bill for that account or a statement of any kind. Never received a default notice. No phone calls. Isn't this the law? Tried contacting the Card company, they want the last 4 digits of the account#,..I don't have. I filed a complaint with the Credit Bureau. All they do is call the collection agency - of course they state it's my account. All of the other accounts on my report are never late or paid in full. And nobody seems to see there is a problem here. I don't even know what kind of lawyer I would be looking for if I needed one. What can I do to get this off my credit report? Thank You.

Re: A Credit Card Account - Not Mine

Yeah credit reporting problems can be a pain.

You have a few options, you can handle the matter on your own by following up with the Consumer Reporting Agency (CRA) (credit report company) and the creditor/collection agency. Once you have done that and you are certain that the debt is not yours you can proceed against both the creditor/collection agency and the CRA. There are statutory penalties for including incorrect information on a credit report. You can handle this yourself in small claims by looking at the Fair Credit Reporting Act. Or you can hire an attorney to handle this matter.

I would be willing to deal with it. But to be frank, unless the item is removed with the firts or second letter then the cost of an attorney usually exceeds the statutory penalty.

Let me know if you'd like me to help with this or any other legal matter.
