Judgement on a debt

My daughter was just served court papers regarding a debt which just falls under the statute of limitations by days. She lives with me and has very little income as a waitress and no assets or property. Should she appear in court and present her case or allow a default judgement to be placed against her...

I could never recommend allowing a default judgment to occur unless the amount was insubstantial. If the lawsuit has been filed by a collection agency, you really need to defend it because most times their lawsuits are legally insufficient. If the original creditor is the named Plaintiff, its more of an uphill battle, but still, you should have a consumer attorney (whether its me or not) review the matter to discuss your options.
