Legal Question in Credit and Debt Law in Pennsylvania

Judgment of Non Pros

A law firm was filed against me on behalf of a credit card company in 2004 that I was unaware of and heard nothing about until 2007 when I received a letter from the Court stating ''Judgment by Non Pros.'' The law firm representing this credit card company just started calling me last week demanding that i pay this debt or the Sheriff will be out to my house to take inventory. Am I legally responsibe for this debt if a Judgment of Non Pros was filed a year ago? This debt was removed by the creditor in July of this year from my credit report and no judgment shows up in my credit report either.

Re: Judgment of Non Pros

If the matter was non processed then there is a strong possibility the statute of limitation has passed and you are not responsible for the debt. In fact the action of the creditor and its law firm if the facts are as you relate may have committed an unfair debt collection activity entitling you to legal recourse. In any event you should consult with an attorney to properly assess the situation. If you would like to schedule a consultation with our office then call to schedule an appointment.
