Legal Question in Credit and Debt Law in Pennsylvania

Validation of debt

I received a letter on 11/17/2008 from a law office demanding payment of $1231 for a supposed phone bill in 2003. They claim to have sent me an initial notice on 3/27/2007 and filed a judgment on 2/26/2008. Not only have I never received any notices from them or the court they filed with, I never heard from the original creditor (phone co.) about this matter. I did have an account with the phone company from 2001 - 2005, when I made final payment, turned off services and moved. I did have a forward on my mail for 6 months, yet did not receive any notices before this 11/17, more than 9 months after they filed judgment. 12/05/2008 I sent a letter requesting ''validation'' and got back (01/09/2009) a letter stating my request for ''verification'' should have been sent after their 3/27/08 notice. Should I demand they prove previous notices? I don't know where to go with this...

Re: Validation of debt

They have to give you notice of a proceeding filed in court in order to get a judgment. Find the judgment...go to the courthouse or the magistrate and find it.

The statute of limitations for contracts in PA is 4 years, so if it's from 2003, they are likely beyond the statute. You need to do some legwork to find out where this judgment is, and how it says you got notice. Then it will be more clear what to do.

Feel free to email me when you get the documents or if you have any questions.
