Boss gives potential customers a choice

Is it legal for my boss to give potential customers a choice weither they want a white or black person to work as a caregiver in their home? He does this all the time in his presentations with them.

You asked whether it was legal for your boss to inquire of customers about racial preferences for caregivers.

This is patently illegal and prohibited by a number of anti-discrimination laws and regulations. Because of the nature of the position a customer could, of their own accord, request a preference. Any comments or suggestions to that effect by an employee (your boss) could be (more likely would be) seen as discriminatory. Such action reinforces stereotypes and even though it purports to satisfy the customer it is not legal. It actionable.
