health code violation

Is it a health code violation for male customers to wear tank tops in a restaurant? Is it discrimination to post a sign no tank tanks allowed for male patrons?

Discrimination against what? Bad taste? It may be a health code violation, but even if it isn't, a restaurant can make any dress code rule it wants. It's a private property owner, just like anyone else, and they can ask anyone to leave. The discrimination laws were not written to prevent ALL discrimination. They were meant to protect people from being discriminated against because of their race, color, national origin, and other historically oppressed groups. They were not written so that you would have a legally enforcible right to wear your Def Leppard tank top to Burger King.
