can i get a dui if i was not caught driving or in physical control of the vehicle

You can only be convicted if you are found to be in actual physical control of the vehicle. Courts have held that at a minimum, the car must be running and the driver must be behind the wheel, plus any other factors that circumstantially suggests the vehicle was driven while the driver was under the influence.
