Legal Question in DUI Law in Pennsylvania

DUI Probation Violation

I got a DUI in May and am currently

on probation until October 2010. Last

night after the Superbowl, I was

hand-cuffed and later released. I was

seen holding open containers and

they searched my purse and found a

fake ID. Should I expect a citation in

the mail? And what will happen due

to my probation? I'd appreciate any

help.

I wouldn't worry about violating your probation just yet. If they have your info and they're really intent upon being bastards about an open container and a fake ID, you'll receive a summons by mail. The fact that they released you last night is definitely a good thing.

Because you haven't been charged with anything yet, you have no reason to report this to your probation officer. If you DO get charged, this seems like something that can be handled at the preliminary level, without having much of an effect on your probationary status.
