Legal Question in DUI Law in Pennsylvania

Non Traffic Citation-Underage drinking

I received a Non-traffic citation for underage drinking last night, and I wasn't sure how to deal with this. The officers caught us in possession and consumption of coors light. We were with 2 23yr olds, who said that it was theirs, but the officers said we were drinking 2, so to try and help we cooperated, and I admitted to having 2 beers. They told me that since I was from NJ I would only have to pay a fine, and suspension of license in PA for 3 months, but since I was from NJ, its taking away something I dont have and wouldnt affect me. I was wondering if this was true? They also said that this citation would not show up on any permanent record, is that true? If all that is true, I believe I should plead guilty, but I wanted some advice. Any way you can help would be great.

Re: Non Traffic Citation-Underage drinking

If your license is suspended in PA, then there is a very strong possibility that it will also be suspended in NJ. This is because of the rule of "commity", which says that any sentence imposed in one state is to be respected by all other states. This is especially true in states that are next to each other like PA and NJ, who routinely report license suspensions to each other's divisions of motor vehicles. Since you were charged in PA I would recommend that you find a PA lawyer to discuss the law in that state with him. I am an attorney that handles traffic and criminal cases in NJ. If you ever have any problems in NJ, please give me a call at 1-908-272-0111 to discuss them. You can also check out my web site at www.njworkerscompensationlaw.com
