Legal Question in Family Law in Pennsylvania

child emancipation

I have a daughter that I pay weekly child support for, $90 wkly. Her father let her quit school without my permission @ 17yrs. old. She is working & making approx. $125 per week, lives with her father who is on welfare, she will not come to live with me. Is she considered emancipated? Is there any way I can stop the support payments, now that she is working. The money is not used for her, her dad uses it all on himself. I still buy her clothes because ( I feel sorry for her) even though I am paying support money, because her father will not use the monies to buy her anything. Am I still liable to pay? I do not pay thru any court order. I have been paying for about a year & 4 months now. I feel like I am being used & they are both working against me. What can I do?

Re: child emancipation

If there's no Order and no agreement, you may simply stop paying. Is her father still married to you? If so, he may be forced by the Department of Public Assistance to file a claim for spousal support. If her father is receiving DPA on a year round basis he must be disabled. He should investigate whether he is eligible for SSI or a non-service connected veteran's pension if he served in the U.S. Military during a period of war.
