Legal Question in Family Law in Pennsylvania

Child Support and subsequent children

I currently pay child support for my 10 year old son. I also have a 6 year old daughter with my current wife. The Domestic Relations office in my county wouldn't consider my daughter's support expenses when I was seeking a reduction. Their reason was that I had no ''court ordered'' child support to pay for her. Now my wife and I are expecting another baby this fall. Do the new PA Guidelines take children of an intact marriage into consideration when calculating child support? Also, my ex was assessed a monthly income of $500, even though her Volvo car payment is $525, and she owns a rental property! My income was imputed to $1200 per month even though I supplied a tax return that stated that my income was $950. Can I get a reduction now, or when my 3rd child is born?

You should be eligible for multi-family calculation. You may also have a reason for a deviation based on her assets. You should get an attorney. I offer free consultations.

Re: Child Support and subsequent children

They should do a multiple family calculation to determine whether their should be deviation from the support guidelines due to the other children. Does not always happen, as they can take up to 50% of your net income for all support combined. Sounds like they should have given her a greater earning capacity and taken into consideration her rental income.

I offer free 1/2 hour consultations and I have several office locations.
