Custody

I was wondering how do I go about filing for custody if there is an order already in place. I am going back becaus my daughter is living with her father but the problem is that she never stays at his house. He always takes her to his mothers house and she stays there and she gets her up and takes her to the babysitters then. if she were living with me she would eb staying in her own bed and I would be the one to get her up and ready for school in the morning. would the court take this into consideration?

The court would take evidence on just about anything which relates to your daughter's well-being. As we say (we lawyers) there is no such thing as a final custody order until the child becomes an adult. So you would file a complaint for custody. Each county has different procedures once it's been filed.

It is really important for you to review your case with a lawyer in your county first for an opinion based on that attorney's experience as to whether the facts of your case might move a judge to change primary custody.
