Re: How to get a divorce

The easiest way to obtain a divorce would be if you could locate your spouse and she would agree to sign a consent to a no fault divorce. If your spouse will not consent to a divorce, you can obtain a no-fault divorce on grounds of separation of two years under Section 3301(d) of the Pennsylvania Divorce Code. To properly serve your spouse through certified & regular mail, you must locate her present address. If you are unable to find the whereabouts of your spouse, after diligent search, you may obtain service through publication. To do this you will need the assistance of an attorney. Service must be accomplished within a set number of days after filing the complaint, depending upon whether the party is in or out of state.

Because you may encounter service problems in your divorce action, you will most likely need to employ an attorney to bring the divorce action for you.
