father in contempt of exsisting court order

The father and I are in two different states-i'm in OH and he is in PA. The child resides with me, but has 48 hour visits with the father 3 weeks then is home a week. The father currently lives with a relative who helps with child's care. This exsisting court order has been in effect since May 2001 and we have not had anything unusual happen just days changed per his job change. And in the court order it is stated that no alcohol is to be consumed 12 hours prior to or during any custody time with the child. I found out by accident that he was arrested after going to a tavern with a friend (while child was in his care) and is in the process of being tried in court for 2 counts of assualt and an involuntary deviate sexual intercourse charge. I need to know what to do about him still having visitations. He never notified me that this happened and obviously is still drinking excessively. He goes to court soon so any suggestions would be appreciated. I am in fear for the child's well-being.

You must file contempt charges based on the facts presented. You did not state what state the order is in, but you must file it there. You might be able to change the court order to supervised visitations for the day but more facts/investigation would be needed. Remember the court holds the best interest of the child first, and if you can prove harm or it is in the best interest of the child to modify the court order, the court should modify it.
