Legal Question in Family Law in Pennsylvania

My husband has primary physical custody of his son and the mother has partial physical custody. The mother is always looking for ways to make my husband stressed and recently she has just out of the blue messaged him telling him that once she gets her son for her weekend that she won't be returning him back to my husband. There is no reason at all for her not to be returning him home. Can she even do that? Would my husband still have to let him go down this weekend since she put the threat out there? If she really does just keep him what is my husband to do?

If she wishes to text stuff like that she's not the sharpest tool in the shed. Text messages are great evidence. Especially if she carries out the threat. It elevates it to criminal contempt. If she does do it you need to file an emergency petition so you get an order that says the police will help you. Also you would file a contempt petition asking for fees and jail time.As well as getting her contact to the child reduced to supervised visitation.
