Medical bill covered but unpaid

My steson is covered under my insurance, he lives with his mother. He had to go to the dr on 2 occasions and she did not give them the corrected insurance information even though we had given it to her.This was in July and August of 05. She is geting a bill and I called the dr office to give them the info since she did not. It has been over 120 days since he date of service so the claim will deny for timely fileling per the insurance contract with the dr. So the bill will not be paid by the insurance now . Since she let this go even though she had the information , shouldn't she be liable for the bill, we are only required to provide insurance for him and she did not follow through with using the policy and let it go till it was too late? She is responsible for his day to day care. I don't feel we should get stuck with his bill when she messed up...

In terms of equity you are correct. Her failure to take advantage of the insurance should NOT put you on the hook for any more money then you would have had to pay had she filed the claim properly.

That said how much money are we talking about? Is she willing to pay for her mistake?

In short is this worth fighting over? That is something you have to decide.
