mortgage deed

need to know if i really need an attorney to get my name off our deed to our house. my husband wants the house and i'm leaving. all i want is my name off of everything. what do i do?

It would make it a lot easier for you if you had an attorney. But if you decide not to hire one the court clerk will likely help you file the necessary documents.

In Pennsylvania you would need to execute a quitclaim deed. Its filed with the recorder of Deeds. You would execute it and your husband would file it.

This will give your husband exclusive title it will NOT remove your name from any mortgages on the property. You will be personally liable for those whether your name is on the deed or not.
