Legal Question in Family Law in Pennsylvania

Physcial custody

I have had physcial custody of my three children for almost two years. My eight year old took her sisters pocket knife to school and was expeled for a week. My ex picked her up at school and said my daughter wants to live with her. Now she refuses to bring her back to my home. My ex is paying me child support she also said she was told I have no wrights with physcial custdoy. What can I do?

Re: Physcial custody

If you have an Order for custody, that order is enforceable. If you do not have an order, your should file a Complaint for Custody. Based upon the fact that you have had primary custody for 2 years, the court, will entertain an emergency petition to return the parties to the status quo ante. You should act promptly or the court may find that you have acquiesced in the change and that it is not in the children's interest to change custody again.

I trust this has been helpful, but feel free to call or e-mail with any questions.
