need the father to give up his rights so my child can be under my last name

Re: to remove rights

No. In terminating his rights you would also be terminating his duty to pay support which is against public policy. Generally parental rights are terminated when the child is to be adopted.

If you wish to change the child's name you petition the court for a name change.
