Legal Question in Civil Litigation in Pennsylvania

Neighbor's Dog

My yard is fenced in, and I allow my dogs to run free inside. My neighbor just opens their front door and allows their dogs to run loose on the sidewalk, then calls them back when they do their duty. One of their dogs (Yorkshire Terrier)came through my gate into my yard, and my dog went after it, hurting, possibly killing(not sure yet)their dog. Can she sue me or hold me responsible for her dog? I tried to make a police report, but the police won't write one up.

Thanks!

Re: Neighbor's Dog

It sounds as if she is the irresponsible one and not you. From your recitation of the facts, you have done nothing improper and your neighbor does not have a claim against you.

Please note that this is just my opinion, but if your neighbor came into my office wanting to sue you, I'd decline the case on the spot.
