Small claims court

I was wrongly accused of stalking and taken to court for a PFA. The charges were not substaniated and the PFA was not granted. The individual that filed the charges, came in my home and caused property damage. I want to sue to reclaim the money for damage, can I also include emotional distress to my suit. The unfounded allegations were spread in a small town and caused not only stress to myself but family as well.

Your question is a tricky one. Generally, the courts would not favor a suit arising out of allegations in a PFA which were found to be unsubstantiated because, they want to encourage people to file when necessary.
